The crime of breach of the Constitution is regulated by Article 309 of the Turkish Penal Code. For this crime to occur; the perpetrators should intend to abolish the Turkish Constitutional order by using force and violence, or to replace the present order with another order or, to prevent the factual implementation of present order. The crime of breach of the Constitution is an attempted crime. For this crime to occur, committing of the crime should have started directly with feasible actions. Force and violence are the elements of this crime, and it is not possible to commit the crime of breach of the Constitution through actions without force and violence. [ABSTRACT FROM AUTHOR]
